CONDITIONS OF SALE

1. OBJECT OF THE ONLINE CONTRACT

The "on-line" contract, accepted on the website "www.american4x4.eu", is intended as stipulated between Quattrotempi di Luttazi Marco & Co. SAS (hereinafter "Quattrotempi"), with registered office in Foligno, Largo F. Neri - Loc.Paciana and a customer, through an electronic sales system called e-commerce. By Customer, in relation to contracts for the sale of goods or the provision of services, we mean the Subject who formalizes a purchase on the site "www.american4x4.eu". The term e-commerce refers to operations of a commercial nature (purchase of products, economic transactions, exchange of commercial information, etc.), carried out electronically via the Internet on the domain "www.american4x4.eu".

2. SALE PRICES, PURCHASE METHOD, BILLING

2.1 The sale prices displayed on the website www.american4x4.euare intended as an offer to the public by Quattrotempi, including VAT. and all other taxes. The prices shown DO NOT include shipping costs. The Customer will take care to view the amount of transport costs before proceeding with the purchase. Quattrotempi reserves the right to change prices at any time, following market changes, typographical errors and active promotions. The purchase contract is concluded only by correctly completing the order form published on the site and by consenting to the purchase, expressed through the online adhesion. The customer can choose the payment method before confirming the order, using one of the allowed methods.
2.2 The payment of the goods by the Customer will take place using the method chosen at the time of the order. Nothing more is owed by the Customer with respect to the total order.
2.3 Quattrotempi reserves the right to contact the Customer to request additional and / or complementary information, for example in the event that the delivery is to be made in a place other than the domicile of the Buyer's residence, or to a different recipient, or in the if there is no landline telephone contact, or for any reason deemed appropriate for the purpose of verifying the consistency, correctness and truthfulness of the order. 2.4 We do not accept bank checks, bank drafts, postal orders, postal orders.If we do not receive payment within 7 days from the execution of the order, the order will be canceled. 2.5 N.B. Article 18 of Legislative Decree no. 114 of 31-03-1998 which equates sales with other communication systems, including e-commerce, to correspondence. Any sales invoice must necessarily be requested from the act of entering the purchase order. It will not be possible to issue an invoice after the order has been fulfilled, or after the delivery of the goods to the freight forwarder in charge of transport.
2.6 Shipping times and delivery methods

Quattrotempi SAS reserves from 2 to 15 working days for the retrieval of the goods, quality control, packaging, and the completion of the necessary administrative procedures, for the items immediately available.
For items not available at the moment and for logistical reasons, Quattrotempi SAS reserves up to 20 working days for the provision of stocks and the fulfillment of orders.For original OEM items, shipping times from order are approximately 20 days . It is useless to request the shipment if the order is being processed and the availability is certain.
The time taken by the courier for delivery must then be added to these days, the times and methods vary depending on the courier that will be used.
If one or more items have a non-restocking status due to the impossibility of restocking, Quattrotempi SAS reserves the right to contact the customer to complete the transaction.

3. COSTS AND METHODS OF TRANSPORT AND DELIVERY

3.1 The shipment of the purchased goods is entrusted to transport companies that carry out a national express courier service. NO LIABILITY CAN BE CHARGED TO FOURTEMPI IN THE EVENT OF LOSS, DAMAGE OR DELAY IN DELIVERY OF THE SHIPPED GOODS.

3.2 Shipping is free only for destinations in Italy, Austria, France, Germany, Belgium, Spain, Portugal, Slovenia, Luxembourg, and the Netherlands. For EU and EXTRA EU shipping costs, the cost is calculated by the system in proportion weight and country of destination.

3.3 Unless explicitly indicated by our Customer Service, delivery means at street level. Upon delivery of the goods by the courier, the Customer is required to check:
- that the number of packages delivered corresponds to what is indicated in the shipping note delivered by the courier;
- that the packaging is intact, not damaged, wet or otherwise altered, even in the sealing materials (adhesive tape, straps).
- Additional notes on delivery: if the package delivered is damaged or altered (eg with the adhesive tape cut and / or replaced), we invite the Customer to accept the package by applying the note "Acceptance with Reserve" on the courier's document. In the event that the courier's delivery document shows "Accepted without reservation of control", it will in no way be possible to obtain the reimbursement provided for by the insurance. We inform customers that the insured shipment provides, in the ways and terms defined by the contracts with the shipper, the reimbursement of Euro 7.50 for each kilogram of goods weight.
3.4 Any problems concerning the physical integrity, correspondence or completeness of the products received must be reported within 7 days of delivery, according to the procedures set out in this document.

3.5 In case of non-collection within 5 working days of the material in stock at the courier's warehouses due to repeated inability to deliver to the address indicated by the Customer at the time of the order, the order will be automatically canceled.

3.6 Please note: All our shipments are delivered free to the customer's domicile without customs clearance (DDU) excluding taxes, duties and local VAT, as commercially in use in the European Community. Therefore, our deliveries include the cost of the goods, the shipping costs up to the address of the recipient. Any additional costs such as customs duties, import taxes, local taxes, local VAT and / or other ancillary charges are the responsibility of the recipient.

4. LIABILITY FOR TRANSACTIONS AND SHIPMENTS

Quattrotempi declines all responsibility in the event of disservices attributable to force majeure, events that prevented the regular success of the contract, and is not responsible for any loss of goods or damage suffered during transport.
Quattrotempi is also not responsible for any illicit and fraudulent use of credit cards, checks and other means of payment, as at no time during the purchase procedure is it able to recognize the buyer's credit card number, who, operating on a secure connection, it sends the data directly to the Banking Institute that manages the service. In the same way, it is not able to check the correct and lawful origin of the credit that is delivered by the customer when the goods are collected.

5. WARRANTIES

5.1 All products sold by Quattrotempi are covered by the manufacturer's standard warranty and by the 24-month warranty for lack of conformity, pursuant to Legislative Decree 24/02. To use the warranty, the Customer must keep the order note inserted in the shipped packages.
5.2 The manufacturer's conventional warranty is provided in the manner illustrated in the documentation inside the product packaging. Quattrotempi will return the component to the Supplier (or possibly to the Service Center in charge) for the verification of the reported defects. If the right to replace the product under warranty is not recognized, Quattrotempi will report the reasons to the Customer, who will be charged for any verification and restoration costs required by the Authorized Assistance, as well as transport costs, if incurred by Quattrotempi.
5.3 The 24-month warranty applies to products that show a lack of conformity, provided that the product is used correctly, in compliance with its intended use and as provided in the attached technical documentation. That guarantee is reserved for the private consumer (natural person who buys goods for purposes not related to his professional activity, or makes the purchase without indicating a VAT number in the order form). In the event of a lack of conformity, Quattrotempi will restore the conformity of the product by repairing / replacing or reducing the price, at no cost to the customer, until the contract is terminated. If the right to replace the product under warranty is not recognized, Quattrotempi will report the reasons to the Customer, who will be charged for any verification and restoration costs required by the Authorized Assistance, as well as transport costs, if incurred by Quattrotempi.
5.4 The replacements in case of DOA (Dead On Arrival, or product not working on delivery) take place only if expressly provided for by the manufacturer. The timing of replacement or repair of the product depends exclusively on the manufacturer's policies.
5.5 In the event that, for any reason, it is unable to return a product under warranty (restored or replaced) to its customer, Quattrotempi may proceed at its discretion to return the entire amount paid or to replace it with a product of equal or superior characteristics.
5.6 No damage can be requested from Quattrotempi for any delays in carrying out repairs or replacements.
5.7 In cases where the application of the guarantees provides for the return of the product, the goods must be returned by the Customer in the original packaging, complete in all its parts (including packaging and any documentation and accessory equipment: manuals, cables, etc. .. .). To limit damage to the original packaging, we recommend, when possible, to provide suitable packaging.
5.8 Warranty limitations may apply on racing equipment, electrical parts, batteries, helmets and hazardous materials Batteries have a 12 month limited warranty

6. COMPLAINTS, RIGHT OF WITHDRAWAL AND REPLACEMENT (Reference legislation: Consumer Code)

6.1 Any complaints must be sent to the e-mail address info@streetrider.it, taking care to indicate the order references.
6.2 RIGHT OF WITHDRAWAL: if the Customer is a consumer (i.e. a natural person who purchases the goods for purposes not related to his professional activity), he has the right to withdraw from the purchase contract for any reason, without the need to provide explanations and without any penalty, with the exceptions expressly indicated in the following points 6.4, 6.6 and 6.7.
6.3 To exercise this right, the Customer must send Quattrotempi a communication to that effect, no later than 14 days from the date of receipt of the goods. This communication must be sent by registered letter with acknowledgment of receipt or certified email, addressed to Quattrotempi di Luttazi Marco & Co. SAS - Largo F. Neri sn - Loc.Paciana - 06034 Foligno (PG) or by certified mail (quattrotempi @ messaggipec.it). Once the aforementioned notice of withdrawal has been received, Quattrotempi will communicate to the Customer the instructions on how to return the goods which must be received within 10 days of authorization.
6.4 The right of withdrawal is however subject to the following conditions:
- The law applies to the product purchased in its entirety; it is not possible to exercise withdrawal only on part of the purchased product;
- the law does NOT apply if there are signs of wear, even partial, of the goods and any consumables;
- the law does NOT apply to complete and specific exhaust systems for motorcycle models;
- the law does NOT apply to tailor-made products, products built on technical specifications requested by the Customer, products that are clearly personalized or which, by their nature, cannot be returned or are liable to deteriorate or expire rapidly. The purchased good must be intact and returned in its original packaging, complete in all its parts (including packaging and any documentation and accessory equipment: manuals, cables, etc ...); to limit damage to the original packaging, we recommend that you provide adequate packaging. The return number provided by Quattrotempi SAS must be clearly visible on the package.The shipping costs for returning the products, in case of application of the Right of Withdrawal, are charged to the Customer, as well as any costs for packaging and / or ancillary services. The shipment, up to the certificate of receipt in our warehouse, is under the complete responsibility of the Customer. In case of damage to the goods during transport, Quattrotempi will notify the Customer of the incident (within 5 working days of receipt of the goods in its warehouses), to allow him to promptly file a complaint against the carrier and obtain reimbursement of the value of the asset (if insured); in this case, the product will be made available to the Customer for its return, at the same time canceling the request for withdrawal. Quattrotempi is in no way responsible for damage or theft / loss of goods returned by uninsured shipments. Upon delivery to its warehouses, the product will be examined to assess any damage or tampering not caused by transport. If the package and / or the original packaging are damaged, Quattrotempi will cancel the restoration costs from the refund amount.
6.5 Without prejudice to any repair costs for damage to the original packaging, Quattrotempi will issue a discount voucher to the Customer for the amount relating to the returned products, net of the shipping costs incurred for sending the first shipment. The only costs charged to the Customer will be those relating to the shipment for the return of the products. No other penalties will be applied. The refund will be made by issuing a discount coupon that can be used within 60 days at the store, for the purchase of other items on sale and available.
6.6 The right of withdrawal is totally lost, due to lack of the essential integrity of the goods (packaging and / or its contents), in cases where Quattrotempi ascertains:
- the lack of the external packaging and / or the original internal packaging;
- the absence of integral elements of the product (accessories, cables, manuals, etc.);
- damage to the product for reasons other than its transport. In case of forfeiture of the right of withdrawal, Quattrotempi will return the purchased good to the sender, charging the shipping costs to the sender.
6.7 Some products for sale show in the information sheet the note "Right of Withdrawal: NOT APPLICABLE". These are products supplied following a specific customer request. ON THESE PRODUCTS IN NO EVENT AND FOR NO REASON WILL THE RIGHT OF WITHDRAWAL APPLY.

6.9 Starting from March 5, 2020, in the event that the buyer who makes a purchase on the site and selects the form of payment with the PayPal system, where later the same buyer requests a refund for any reason and for any reason of the amount paid, this refund will not include the fees withheld by PayPal (equal to a fixed sum of 0.35 euros + a variable sum equal to 3.4% of the amount paid), but only the net of the transaction. Furthermore, any tariffs relating to transport, cash on delivery, etc. could also be further deducted from this net. etc., for any reason and in any form, thus proceeding with the reimbursement of the resulting net only

7. BUYER'S OBLIGATIONS

The consumer undertakes and undertakes, once the "on-line" purchase procedure has been completed, to print and keep these general conditions, which, moreover, he will have already viewed and accepted, as a mandatory step in the purchase, as well as the specifications of the product being purchased. It is strictly forbidden for the purchaser to enter false and / or invented and / or fictional data in the registration procedure necessary to activate the procedure for the execution of this contract and the related further communications for him; the personal data and the e-mail address must be exclusively their own real personal data and not those of third parties and / or fictional ones. It is expressly forbidden to make double registrations corresponding to a single person or to enter data of third parties. Quattrotempi reserves the right to legally pursue any violation and abuse, in the interest and for the protection of consumers.

8. AUTHORIZATIONS

By filling in the appropriate space on the website, the Customer authorizes Quattrotempi to use their credit card, or other card issued to replace it, and to debit their current account in favor of Quattrotempi the total amount shown as cost. of the purchase made "on-line". The procedure takes place via a secure connection directly connected to the Banking Institute, owner and manager of the "on-line" payment service, to which Quattrotempi cannot access. Should the consumer exercise the right of withdrawal (see point 8 of these general conditions), the amount to be refunded will be credited to the same credit card or in the manner chosen by the customer.

9. CONTRACTUAL TERMINATION AND EXPRESS TERMINATION CLAUSE

Quattrotempi has the right to terminate the stipulated contract by simply notifying the Customer. In this case the Customer will only be entitled to a refund of any sum already paid. The obligations assumed by the Customer pursuant to art. 7 (Obligations of the buyer), as well as the guarantee of the successful completion of the payment that the customer makes with the means referred to in art. 2 (sales prices and purchase methods), are of an essential nature, so that by express agreement, the non-fulfillment by the Customer of only one of these obligations will result in the legal termination of the contract, without the need for a judicial decision, without prejudice to the right for Quattrotempi to take legal action for compensation for further damage.

10. TREATMENT OF PERSONAL DATA

By accepting these conditions of sale, the Customer declares to have read, understood and accepted in full, and without any reservation, the rules governing the processing of personal data, set out in the specific section on the website ("Privacy").

11. APPLICABLE LAW

The sales contract between the customer and Quattrotempi is concluded in Italy and governed by Italian law. For the solution of any civil and criminal disputes arising from the conclusion of this sales contract, the jurisdiction is exclusively that of the Court of Perugia.
